Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of the Comitas.ai website and agentic AI platform (the "Service"), operated by Comitas AI, Inc. ("Comitas," "we," "us"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and access

You must be able to form a binding contract to use the Service, and must be at least 18 years old or the age of majority in your jurisdiction. The Service is not directed at children.

Comitas is currently in a private early-access phase. Access is by invitation or referral, not open self-serve signup. We may change, pause, or expand access at our discretion as we scale.

3. The Service, and the third-party providers it relies on

Comitas is model-agnostic: the Service is built to work with infrastructure and AI model providers other than Comitas itself ("Third-Party Providers") to deliver agentic workflows. We select and configure which Third-Party Providers power the Service at a given time; we do not always publicly name them, since that selection may change as we evaluate cost, capability, and alignment with our own commitments (see our 105% climate pledge). As those relationships stabilize, we intend to publish a list.

When your use of the Service requires it, your inputs are transmitted to the relevant Third-Party Provider to generate a response. We only select Third-Party Providers whose own applicable terms commit not to use your data to train their models — see our Privacy Policy for how we verify that, and for what happens if a provider's terms ever change. We do not control, and are not responsible for, a Third-Party Provider's own availability or security practices. The Service is provided on an "as available" basis with respect to any particular provider or model.

Comitas itself does not use your content to train models, and does not retain it beyond what's described in our Privacy Policy.

4. Your account

You're responsible for the activity on your account and for keeping your credentials secure. Provide accurate information when you create an account, and keep it up to date.

You can delete your account and associated data at any time through the Service application without requiring a support case.

5. Fees and billing

Comitas is priced on actual usage: there is no flat base fee. You pay for the infrastructure and model costs your usage actually incurs, plus a platform fee expressed as a percentage of your utilization. We actively tune that percentage over time as we gain more understanding of our own environmental-offset obligations and become more operationally efficient — see our pricing philosophy for the reasoning behind this.

Payments are processed by Stripe. We do not store your payment card details ourselves.

New accounts may be offered a free, bounded guided experience at our discretion ("Starter Access"). Starter Access is promotional: it has no cash value, is not transferable, is not refundable, and we may modify, limit, or discontinue it at any time. Once you've exhausted Starter Access, continued use is billed per the usage model above.

6. Acceptable use

You agree not to:

• Use the Service for any illegal purpose, or to violate the rights of others.
• Attempt to disrupt, overload, or gain unauthorized access to the Service or its underlying infrastructure.
• Reverse engineer or attempt to extract the underlying models or systems the Service relies on.
• Use the Service to generate content that is fraudulent, deceptive, or intended to cause harm.
• Resell or provide the Service to third parties without our prior written consent.
• Use referral or promotional mechanisms in bad faith, including creating multiple accounts to obtain Starter Access repeatedly.

7. Your content

You retain ownership of the content you submit to the Service and the outputs generated for you. You're responsible for having the rights to any content you submit. You grant us the limited right to process your content, including transmitting it to Third-Party Providers as described above, solely to provide the Service to you.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms, or if we discontinue the Service or a particular access tier, with notice where reasonably possible.

9. Disclaimers and limitation of liability

The Service, including any output generated through it, is provided "as is." AI-generated output can be incorrect or unsuitable for your purpose; you're responsible for reviewing it before relying on it. To the maximum extent permitted by law, Comitas is not liable for indirect, incidental, or consequential damages arising from your use of the Service.

Nothing in this section limits liability where it cannot be limited under applicable law.

10. Changes to these Terms

We may update these Terms as the Service evolves. We'll post the revised Terms here with an updated date. Continued use after a change means you accept the update.

11. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
